When a Muslim dies in Manitoba

Registering the death
Every death in Manitoba must be registered. The funeral director asks the nearest relative, or another person who knows the facts, for the personal particulars, and the doctor or nurse practitioner who cared for the person must complete the medical certificate within 48 hours. Give the funeral director the full details promptly and ask when the registration has gone in. The Vital Statistics Act, C.C.S.M. c. V60
Coroner or medical examiner
If the death falls under The Fatality Inquiries Act, no burial permit can be issued until the inquiry has been conducted and the medical examiner has signed the medical certificate. Release and burial permit
No one may bury the body, take it out of the province, or lead a funeral or religious service until the death is registered and a burial permit has been issued, and the person leading the service must hold the permit. A medical examiner can release the body once it is no longer needed. Ask the funeral director to confirm the permit before you set the time of the janazah. The Vital Statistics Act, C.C.S.M. c. V60
Probate and the estate
Probate (where there is a will) and administration (where there is none) are court grants under The Court of King’s Bench Surrogate Practice Act. Small estates
Where the whole estate is $10,000 or less, the court can order the personal property paid out without a grant of probate or administration, to cover funeral costs and debts first and then to those entitled. Benefits
Service Canada pays a one-time Canada Pension Plan death benefit if the person contributed enough; the executor or administrator applies if there is an estate. Ask the executor to apply through Service Canada once the death certificate is issued. Canada Pension Plan death benefit (canada.ca)

  2. Close the eyes, cover the body, make duʿā

  3. Call the masjid’s funeral committee

    They arrange the washing, the shroud, the prayer and the burial, and usually know which funeral home to use.

  4. Ask whether a coroner or medical examiner is involvedPaperwork

    After a sudden, unexplained or violent death, a coroner (in some provinces a medical examiner) investigates and may order an autopsy, which can delay burial.

  5. Choose a funeral home that allows ghuslPaperwork

    Most families use a funeral home, or a masjid’s own licensed funeral service. Your committee will usually name one.

  6. Register the death and get the burial permitPaperwork

    A doctor, nurse practitioner or coroner certifies the cause of death. The funeral home and a family member give the personal details, and the death is registered with Manitoba. Burial needs a permit.

  7. Wash and shroud the body

    Done by trained Muslims of the same sex, or by the spouse. The committee usually provides the cloth.

    Banks, insurers and government offices will each want proof of death. A certificate can only be issued once the death is registered.

  10. Pay the funeral costs and list every debt

    The funeral is paid from the estate first, then the debts. Nothing is inherited until both are settled.

    Probate is provincial, so the steps and fees depend on Manitoba. Small estates may need no grant at all. One call to a local estate lawyer (in Quebec, a notary) will tell you.

    A woman keeps the prescribed mourning (iḥdād: setting aside adornment and perfume) for no more than three days for any death, except for her husband: then four months and ten days, the length of her ʿiddah, or until she gives birth if she is pregnant.
