إِنَّا لِلَّهِ وَإِنَّآ إِلَيْهِ رَٰجِعُونَ
Innā lillāhi wa innā ilayhi rājiʿūn. Indeed we belong to Allah, and indeed to Him we will return. Qurʾān, al-Baqarah 2:156
When a Muslim dies in Northwest Territories
As soon as you can, call your masjid’s funeral committee. They will arrange the washing, the shroud, the prayer and the burial, and tell you which funeral home to use.
You do not have to do this alone, or all at once. Your masjid has done this many times. Follow the steps in order, and open each one when you reach it.
NewThis guide is new and under review by people in Canada. Each province and territory has its own rules on registering a death, coroners, probate and wills; the notes for each province and territory are drawn from official sources and say when they were checked. If something is wrong or out of date where you live, please tell us.
- Registering the death
- The funeral planner, meaning the person who takes charge of the body, submits the death registration statement to the subregistrar for the community or to the Registrar General. Give the funeral planner the details at once. Vital Statistics Act, S.N.W.T. 2011, c. 34, ss. 60–61, 70
- Coroner or medical examiner
- Every person must immediately notify a coroner or police officer of a reportable death, such as one from violence, accident or sudden unexpected causes. We found no published rule on religious objections, so tell the coroner early if you have one. Coroners Act, R.S.N.W.T. 1988, c. C-20, ss. 8, 20
- Release and burial permit
- No one may bury or cremate the body, lead a funeral or religious service, or move the body out of the community without a burial permit. The permit can be issued even if the cause is still pending a post-mortem, once the body has been released, and a coroner can authorize release after the investigation or the post-mortem. Ask the funeral planner to confirm the permit before you set the time. Vital Statistics Act, S.N.W.T. 2011, c. 34, ss. 60–61, 70
- Probate and the estate
- Grants of probate and administration are applied for in the Supreme Court under the Estate Administration Rules. Ask the executor to read the Rules or consult a lawyer before acting on the estate. Estate Administration Rules, R-123-2016, rr. 10–11
- Small estates
- An estate whose net value reasonably appears to be less than $35,000 is a small estate, and the court may declare it so and authorize the applicant to administer it without a grant. Ask the court registry about the small estate application. Estate Administration Rules, R-123-2016, rr. 10–11
- Benefits
- Service Canada pays a one-time Canada Pension Plan death benefit if the person contributed enough; the executor or administrator applies if there is an estate. Ask the executor to apply through Service Canada once the death certificate is issued. Canada Pension Plan death benefit (canada.ca)

The steps
-
Have the death pronounced
In the first hour · 0 of 4A death has to be confirmed before anything else can happen.
-
Close the eyes, cover the body, make duʿā
In the first hour · at the same time as the step above · 0 of 4Gently and without hurry. Those present can do this while the calls are made.
-
Call the masjid’s funeral committee
In the first few hours · 0 of 3They arrange the washing, the shroud, the prayer and the burial, and usually know which funeral home to use.
-
Ask whether a coroner or medical examiner is involvedPaperwork
If the death was sudden · 0 of 3After a sudden, unexplained or violent death, a coroner (in some provinces a medical examiner) investigates and may order an autopsy, which can delay burial.
-
Choose a funeral home that allows ghuslPaperwork
Within the first day · 0 of 4Most families use a funeral home, or a masjid’s own licensed funeral service. Your committee will usually name one.
-
Register the death and get the burial permitPaperwork
Within the first days · at the same time as the step above · 0 of 3A doctor, nurse practitioner or coroner certifies the cause of death. The funeral home and a family member give the personal details, and the death is registered with Northwest Territories. Burial needs a permit.
-
Wash and shroud the body
Within the first day · at the same time as the step above · 0 of 2Done by trained Muslims of the same sex, or by the spouse. The committee usually provides the cloth.
-
The janazah prayer and the burial
As soon as possible · 0 of 4The prayer is often held after one of the daily prayers, and the burial follows straight after.
-
Get copies of the death certificatePaperwork
In the first week · 0 of 3Banks, insurers and government offices will each want proof of death. A certificate can only be issued once the death is registered.
-
Pay the funeral costs and list every debt
In the first weeks · 0 of 3The funeral is paid from the estate first, then the debts. Nothing is inherited until both are settled.
-
Find the will, and tell Service CanadaPaperwork
In the first weeks · at the same time as the step above · 0 of 4The executor (in Quebec, the liquidator) named in the will leads what follows.
-
Settle and divide the estatePaperwork
In the months after · 0 of 4Probate is provincial, so the steps and fees depend on Northwest Territories. Small estates may need no grant at all. One call to a local estate lawyer (in Quebec, a notary) will tell you.
-
Look after the family
Four months and ten days · 0 of 3A woman keeps the prescribed mourning (iḥdād: setting aside adornment and perfume) for no more than three days for any death, except for her husband: then four months and ten days, the length of her ʿiddah, or until she gives birth if she is pregnant.
