When a Muslim dies in Arkansas

You do not have to do this alone, or all at once. Your masjid has done this many times. Follow the steps in order, and open each one when you reach it.

As soon as you can, call your masjid’s funeral committee. They will arrange the washing, the shroud, the prayer and the burial, and tell you which funeral home to use.

What Arkansas law says
Death certificate filing
The funeral director who first takes custody of the body files the death certificate with the Division of Vital Records within ten days after the death, and the medical part is completed electronically. Ask the funeral home to confirm when it has been filed. Ark. Code § 20-18-601
Ordering death certificates
Certified death certificates come from the Arkansas Department of Health, Vital Records Section, in Little Rock, and each request needs a photo ID of the person asking. Ask the funeral home how many copies you will need before you order. Where to Write for Vital Records: Arkansas
Objecting to an autopsy
Arkansas law says no autopsy or inquest is required where someone died without medical care solely because they were being treated by prayer or spiritual means in a recognized church. We found no statute that lets a family refuse an autopsy on religious grounds in other cases, so tell the coroner or medical examiner about your objection early. Ark. Code § 12-12-315
Small estates
Forty-five days after a death, a distributee can use a small estate affidavit if all property the person owned, less encumbrances, is worth $100,000 or less. If the estate includes real property, a notice must be published within 30 days after the affidavit is filed, which gives creditors three months to make claims. Ask the circuit court clerk about the forms. Ark. Code § 28-41-101
